Funeral Directors book burial and cremation services with us for their client families. This page contains information required by our Funeral Directors clients booking these services.

Cremations

Under the Interment Industry Scheme (IIS) in NSW, Crematorium Operators in NSW are required to have a signed contract with cremation Applicants before providing a cremation service. The InvoCare Cremation Contract is available on this page and applies across all our NSW Crematoriums.

The regulatory intent behind this consumer contract is to ensure the Cremation Applicant’s may clearly distinguish between the products and services being provided by the crematorium Operator, and those being provided by the Funeral Director. To assist with this, the Cremation Agreement clearly stipulates:

  • The products and services being supplied by the Operator for the cremation service. 

  • Operator pricing for these items.

  • The Operator’s terms and conditions for the cremation service.

Crematorium Operators must enter a contractual agreement with a cremation Applicant before providing the cremation service.

All Cremation paperwork submitted to InvoCare is completed by our Funeral Directors with the client family. As per the current approach with Cremation Paperwork, the Cremation Contract is designed for completion with the client family by the Funeral Director at the time of arrangement.  

We understand that similar contracts are in place with other Operators that our Funeral Director clients work with. To streamline processes for all Funeral Directors, we have endeavored to align our contract with those already in use by other Operators.

As this contract, along with existing paperwork, is a legislative requirement to provide a cremation service, it is incumbent on us to assist you, the  Funeral Director community to understand the cremation contract. Provided below are Frequently Asked Questions to aid in understanding this legislative requirement.

Please note: the Cremation Agreement applies for all Cremations book in our NSW crematoriums. This is not required for our locations in other Australian States. All cremation paperwork (which in NSW includes the Cremation Agreement) must be submitted to us at minimum 24 hours the business day prior to service. We are not permitted, by legislation, to carry out a cremation without all complete and accurate supporting paperwork.

Frequently Asked Questions

Can a cremation take place without a valid Agreement?

We, the Operator, would be in breach of NSW government regulation. Such breaches can lead to penalties, an infringement notice, or even the loss of our licence to operate the crematorium. We cannot permit a cremation to go ahead without a signed

Is the Cremation Agreement required for InvoCare’s crematoriums based in Queensland?

No, this is NSW requirement only.

Why are Funeral Directors being asked to discuss this contract with Applicants.

The Funeral Director is our intermediary with the Applicant. The Applicant is already liaising with the FD to coordinate the funeral and all other regulatory paperwork. Introducing a secondary party the Applicant will need to liaise with purely for the Cremation Agreement complicates the process for our families.

Do Funeral Directors also need to sign the Cremation Agreement?

The Funeral Director is our representative in this instance, and as such will need to verify they have explained key concepts and our policies as relevant for this Agreement. As per the model contract stipulated by the regulator, Funeral Directors will need to sign declarations in the Cremation Agreement as our “Authorised Agent”.

Who can sign the Cremation Agreement as the Applicant?

It is the Funeral Directors responsibility to ensure that, in accordance with the NSW Public Health Regulation 2022 (Division 4), the Applicant is either an Executor, relative, or proper person (not a Funeral Director, except in the circumstance of a destitute cremation). This extends to all regulator paperwork for a disposition.

Note also that as Funeral Directors, for cremations booked in NSW, need to sign declarations on behalf of the Operator – declaring themselves as the Applicant also may lead to a conflict of interest. 

Would InvoCare ever reject the contract and why?

Yes, where Applicant and/or Deceased details do not match the other paperwork and/or name plate on the deceased coffin.

The contract will also be unacceptable if any signatures are missing.

Why was this contract not addressed through existing regulatory paperwork, or as a centralised government template?

The Cremation Agreement stipulates the commitment from the Operator regarding the service they will provide and the pricing for these – and as such this needs to be separate document customised for each Operator.

Burials

The Applicant for a Burial must be able to provide details for a site in the cemetery into which their loved one may be interred. The Interment Right Holder for an interment site holds the legal authority for all decisions pertaining to interments in that site. The deceased must either be the Interment Right Holder for this site, or otherwise be a person nominated by the Interment Right Holder. We may ask for documentation to support identification for the deceased, or confirmation from the holder of right, as part of ensuring the interment is compliant with State-based legislations.

If the deceased does not have access to a site, one will need to be purchased in the cemetery before we are able to confirm the Burial Booking.

All burial paperwork must be submitted to us at minimum 48 hours the business day prior to service. We are not permitted, by legislation, to carry out a burial without complete and accurate supporting paperwork and a site into which the deceased has a right to be interred.

Booking with our Memorial Parks & Crematoriums

All bookings need to be made by Funeral Directors and not by the client family. The funeral Director will need to contact our Booking Office for the location at which the Burial or Cremation need to take place.

Service Instruction Forms must be completed and submitted to our Booking Office before we can confirm the booking. The details on this form pertaining to the Applicant and the Deceased must be consistent with the regulatory paperwork completed for the cremation or the burial.
